Terms of Service

These Terms govern your use of getsurgeready.com (the "Site"), our downloadable document kits (the "Kits"), and our drill-management software (the "Software"). By purchasing, downloading, creating an account, or using any of them, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.

1. The Kits — license and refunds

• License. A Kit purchase grants your single organization a perpetual, non-exclusive license to use, customize, and reproduce the documents for that organization's internal compliance and training purposes.
• What you may not do: resell, redistribute, publish, or share the templates outside your organization, or use them to build a competing product. Consultants may purchase per client organization or contact us for a consultant license.
• Refunds. 30-day money-back guarantee: if the Kit doesn't meet your needs, reply to your receipt within 30 days for a full refund. You keep the disclosure of ideas; the license terminates on refund.
• Updates. Where we advertise updates (for example, after CMS revises Appendix Z), we deliver them by email to the purchase address for the advertised period. Keeping that address current is your responsibility.

2. The Software — accounts and subscriptions

• Accounts. You must provide accurate information and keep credentials confidential. You are responsible for activity under your organization's accounts. Organization administrators control who joins their organization.
• Trials and billing. New organizations receive a free trial (currently 14 days, no card required). Paid plans are billed per organization, monthly or annually, via our payment processors or by invoice/purchase order. Fees are non-refundable except as required by law or stated otherwise in writing.
• If you stop paying: your organization becomes read-only — existing exercises and reports remain accessible for at least 12 months, and you can export reports at any time. We do not delete a lapsed organization's records without notice.
• Your data is yours. You own the content your organization enters. You grant us only the rights needed to operate the service (store, process, display it to your organization, back it up).
• Acceptable use. No attempts to access other organizations' data, probe or overload the service, or use it unlawfully. We may suspend accounts that do.

3. Exercise use only — life-safety disclaimer

The Software is designed exclusively for simulated exercises, drills, and preparedness documentation. It is not an emergency notification, dispatch, incident command, or clinical system, has no guaranteed availability, and must never be relied upon during an actual emergency or for the care of real patients. Do not enter real patient information — simulated patients only (see the Privacy Policy).

4. No professional advice; your responsibility

Kits and Software content reflect our good-faith reading of publicly available regulations (such as 42 CFR provisions and the CMS State Operations Manual Appendix Z) and exercise doctrine (such as HSEEP) at the time of writing. Regulations change and surveys are conducted by humans with discretion. You are responsible for customizing all materials to your organization, verifying current federal, state, and local requirements, and obtaining your own legal or regulatory counsel. We do not warrant that use of our products will result in passing any survey, inspection, audit, or accreditation, or in regulatory compliance.

5. Warranty disclaimer

THE SITE, KITS, AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURGEREADY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, REGULATORY PENALTIES, OR SURVEY OUTCOMES, ARISING FROM OR RELATED TO THE PRODUCTS. OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those, these limits apply to the fullest extent permitted.

7. Indemnification

You will indemnify and hold SurgeReady harmless from claims arising out of your use of the products in violation of these Terms, your violation of law, or content your organization enters into the Software.

8. Intellectual property

We (or our licensors) own the Site, Kits, Software, and all associated branding. Except for the Kit license in Section 1 and your right to use the Software during your subscription, no rights are transferred. HSEEP is a FEMA program and CMS/Medicare are programs of the U.S. government; no affiliation or endorsement is implied.

9. Termination

You may close your account at any time. We may suspend or terminate access for material breach of these Terms after notice where practicable. Sections 3–8 and 10–11 survive termination.

10. Changes

We may update these Terms; material changes will be posted here with a new effective date, and for Software subscribers, notified by email. Continued use after the effective date constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, excluding its conflict rules. Disputes will be resolved in the state or federal courts located in the county of our principal place of business in California, and the parties consent to their jurisdiction.
